BuyBack Program Terms

Introduction

Please read these terms and conditions carefully. By submitting any book to Banana Books for purchase, you agree to the Terms and Conditions provided below.

The Banana Books BuyBack Program is designed to provide an opportunity for any eligible seller ("Program Participant") to receive payment via PayPal or check in exchange for their books (the "BuyBack Program," or the "Program").

1. Eligible Item Submission

By submitting a book ("Eligible Item(s)") for the BuyBack Program, you acknowledge and affirmatively agree to the following:

1.1 Warranty of Ownership

You warrant that any item you submit to the BuyBack Program is not counterfeit and was obtained legally by you.

1.2 Approved Items Only

You will not send us any items except the Eligible Items approved by Banana Books in the Eligible Item Offer. You agree that if you send us Excluded Items (items not specifically approved, items not in acceptable condition, or items shipped after the Eligibility Period), we may discard those items without payment or liability to you, and we will not issue any refund nor return any item to you.

1.3 Risk of Loss

The risk of loss of items submitted as part of the BuyBack Program will remain with the Program Participant until Banana Books accepts the Eligible Item after receiving and inspecting it. Banana Books is not responsible for any loss or damage incurred during shipping. For delayed or lost Eligible Items, Program Participants must contact the shipping carrier.

1.4 Communication Consent

We may send you emails at the email address associated with your BuyBack Request, unless you later withdraw your consent. Pursuant to our Privacy Policy, we may record, use, and keep any information that you provide to us as part of your participation in the BuyBack Program.

2. Program Enrollment

2.1 Eligibility

You must be at least 18 years old to participate
If you are between 13 and 18, you may only participate with a parent or legal guardian who accepts these terms
You may not participate if you are under the age of 13
To participate, you must create a Banana Books account

2.2 Qualifying Requests

Requests to sell an item to Banana Books (a "BuyBack Request") must be made through our Website or mobile app to qualify for the Program.

3. BuyBack Program Process

3.1 Submitting a Request

To submit a BuyBack Request, enter your personal information and the book identifying code (ISBN) from the Eligible Item into the request form, select your payment method (PayPal or check), and submit to receive a price quote (the "Eligible Item Price"). We reserve the right to refuse to buy any item.

3.2 Shipping Options

Free Shipping: We provide a pre-paid shipping label for US-based sellers
Local Pickup: Available for Kerrville, TX area residents
Drop Off: Bring books directly to our location for same-day payment

3.3 Price Validity Period

The Eligible Item Price is valid for seven (7) calendar days from the date you receive the price quote (the "Eligibility Period"). You must ship the Eligible Item(s) to us within the Eligibility Period to qualify for the Program.

3.4 Payment Processing

Promptly after our receipt and acceptance of the Eligible Item(s), we will process payment consistent with the Eligible Item Offer and these BuyBack Program Terms. Payment will be made via PayPal or check according to your selection when the BuyBack Request was submitted.

4. Acceptable Condition

Acceptable condition for books means a readable copy where:

All pages and the cover are intact
The dust cover may be missing
Pages may include notes in pen or highlighter, but notes do not obscure the text
No water damage, mold, or excessive wear

5. Excluded Items

Excluded Items will not be accepted as part of the Program and will not be returned to the Program Participant if shipped to Banana Books. Excluded Items are:

Items that do not match the description in the Eligible Item Offer
Items shipped after the Eligibility Period deadline
Items we have reason to believe are counterfeit or stolen
Items not in acceptable condition
Incomplete book sets (if you send fewer than all books in a set associated with a single ISBN)

Important: Banana Books does not return any items, regardless of the reason for the requested return. If you have doubts about the condition or ISBNs of your items, please contact us or send pictures before shipping.

6. Disclaimer of Warranty & Limitation on Liability

IMPORTANT LEGAL NOTICE

YOU EXPRESSLY AGREE THAT USE OF THIS SITE AND THE BUYBACK PROGRAM IS AT YOUR SOLE RISK. BANANA BOOKS DOES NOT WARRANT THAT USE OF THE SITE OR BUYBACK PROGRAM WILL BE UNINTERRUPTED OR ERROR FREE.

THE BUYBACK PROGRAM AND SITE ARE MADE ACCESSIBLE ON AN "AS IS" AND "AS AVAILABLE" BASIS. BANANA BOOKS HEREBY DISCLAIMS ANY AND ALL REPRESENTATIONS, WARRANTIES AND CONDITIONS, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THOSE OF DATA ACCURACY, TITLE, NONINFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE.

BANANA BOOKS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR PARTICIPATION IN THE BUYBACK PROGRAM.

IN NO EVENT WILL BANANA BOOKS' LIABILITY IN CONNECTION WITH YOUR PARTICIPATION IN THE BUYBACK PROGRAM EXCEED $50.

PROGRAM PARTICIPANT ACCEPTS ALL LIABILITY for the loss of any item as part of the Program Participant's participation in the BuyBack Program, regardless of the reason for such loss.

7. Amendments, Modifications, and Termination

7.1 Right to Modify

We reserve the right to modify these BuyBack Program Terms or to discontinue the BuyBack Program at any time, with or without notice to you, including effective upon our posting an updated version of these BuyBack Program Terms on our Website.

7.2 Right to Terminate Account

We reserve the right to suspend or terminate your participation in the Program without notice to you, including if we determine in our sole discretion that you have violated this Agreement or that the use of your account may be unauthorized, deceptive, fraudulent, or otherwise unlawful.

8. Governing Law

These BuyBack Program Terms are governed by the laws of the State of Texas, United States. In the event of any conflict between this Agreement and the Banana Books Terms of Service, the Banana Books Terms of Service control.
